П. против Б. П.  Б.  иск за установяване по отношение на ответника на нищожност на договор за покупко - продажба на апартамент № 4, находящ се на втория етаж от четириетажна, с партер и мансарда, жилищна сграда, построена в дворно място в гр. П., с административен адрес ул.". № 19, цялото застроено и незастроено от 264 кв.м., съставляващо парцел ****11, имот пл. № 123 от кв. 39 по плана на гр. П., със застроена площ на апартамента от 83,28 кв. м., състоящ се от две стаи, дневна, кухненски бокс, баня, пералня, тоалетна и антре, ведно с избено помещение № 5 с площ от 8,73 кв. м., както и 8,73 % от общите идеални части на сградата и от правото па строеж върху мястото, сключен на 29.11.2000 г., обективиран в нот.акт № 100, том 4, per. № 4344, н.д. № 787 от 2000г. на нотариус Н. Д. с район на действие Пловдивски районен съд, per. № 036 като сключен при липса на съгласие от продавача - ищец, действащ чрез своя пълномощник Г. И. П. е пълномощно per. № 3784 от 09.08.2000г. на нотариус Т. К. <o:p></o:p></p> <p class=3DStyle8 style=3D'line-height:15.85pt;mso-line-height-rule:exactly; mso-pagination:widow-orphan'>Решението е постановено при участието на трето лице помагач Р. К. Т.. Осъдена е ищцата В.М. да заплати на  Б. П. Ст.  Д. с оплакване за порочност на решението изцяло. Моли същото да бъде отменено и да бъде постановено друго по същество, с което искът да бъде уважен в така,както е предявен. Б.  чрез процесуалния си представител адв. Й. изразява становище за неоснователност на въззивната жалба и моли като правилно и законосъобразно обжалваното решение да бъде потвърдено, не претендира разноски. Същото становище изразява с писмена молба чрез процесуалния си представител адв. А. третото лице Р.  Т. <o:p></o:p></p> <p class=3DStyle5 style=3D'margin-top:.5pt;line-height:15.85pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Апелативният съд, след като обсъди събраните по делото доказателства поотделно и в тяхната съвкупност с оглед изискванията на чл.267 - 273 ГПК и като съобрази доводите, наведени от страните, прие за установено следното:<o:p></o:p></p> <p class=3DStyle5 style=3D'text-indent:70.55pt;line-height:15.85pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Въззивната жалба е подадена в срока по чл.259 ал.1 ГПК,от легитимирана страна при наличие на правен интерес от обжалване, по отношение на същата са налице останалите особени изисквания на закона, поради което Апелативният съд приема, че въззивната жалба е допустима и следва да бъде разгледана по същество.<o:p></o:p></p> <p class=3DStyle5 align=3Dleft style=3D'margin-left:71.05pt;text-align:left; text-indent:0cm;line-height:15.85pt;mso-line-height-rule:exactly;mso-pagination: widow-orphan'>Предявен е иск с правно основание чл.26 ал.2 ЗЗД.<o:p></o:p></p> <p class=3DStyle5 style=3D'text-indent:69.35pt;line-height:15.85pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>В исковата си молба против ответника Б. Б.  ищцата В.М. твърди,че собственик на недвижим имот - апартамент № 4, находяш се на втория етаж от четириетажна, с партер и мансарда, жилищна сграда, построена в дворно място в гр. П., ул.". № 19, с площ от 83,28 кв.м, като е придобила собствеността чрез покупко-продажба на правото на строеж и цесия на правото да получи недвижимия имот. Твърди също така,че поради постоянното й пребиваване в талия упълномощила лицето Г.П. да я представлява пред трети лица, държавни органи и институции.<o:p></o:p></p> <p class=3DStyle5 style=3D'text-indent:70.8pt;line-height:15.85pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Ищцата твърди,че при завръщане от  И. на 31.08.2004 г.установила, че няма достъп до закупения от нея апартамент. След неуспешни опити да се свърже с П. , ищцата извършила справки, от които констатирала, че процесното жилище е продадено на Б. П. Б. с нот.акт № 100, том 4, per. № 4344, дело № 787 от 2000 г. на нотариус  М. Д. с район на действие РС-Пловдив. Сочи още, че, при изповядването на сделката са представени декларации съгласно чл. 226 от ДОПК и чл. 25 от ЗННД, които ищцата не е подписвала и че нотариалните заверки върху тях са с фалшифицирани печати на нотариус  К.  С.  Д. с район на действие РС-Пловдив. Твърди, че по случая е образувано дознание № 753/2004 г. по описа на сектор „И." при ОД „П." Пловдив срещу неизвестен извършител за престъпление по чл. 309, ал. 1 от НК. Въз основа на изложеното, моли съда да постанови решение, с което да прогласи за нищожен, поради липса на съгласието й, договор за покупко-продажба на недвижимия имот,оформен с нот.акт № 100, том 4, per. № 4344, дело № 787 от 2000 т. на нотариус Н. Д. с район на действие РС-Пловдив.<o:p></o:p></p> <p class=3DStyle8 style=3D'margin-top:.25pt;text-indent:42.0pt;mso-pagination:widow-orphan'>Ответникът - Б. П. Б. чрез адв. Г.Й.. оспорва предявения иск. Твърди, че при сключване на сделката са представени всички необходими документи, легитимиращи продавача като собственик на имота, което е свидетелство за изразена обща воля и съгласие за сключването й. Ответникът сочи, че по отношение на последния по ред собственик на имота, като добросъвестен владелец следва да се приложи кратката придобивна давност като към нея може да се присъедини и владението на праводателите му. Оспорва като недоказани и твърденията за сключен договор за цесия, за липса на представителна власт по пълномощното за сключване па разпоредителни сделки п за неистинност на декларацията по чл.226 ДПК /отм./.<o:p></o:p></p> <p class=3DStyle9 style=3D'mso-pagination:widow-orphan'>Третото лице помагач Р. К. Т., чрез пълномощника си адв. А., в качеството на последващ приобретател на процесния имот и владелец на същия, оспорва иска като твърди, че сделката е сключена при наличие на надлежно упълномощаване.<o:p></o:p></p> <p class=3DStyle9 style=3D'text-indent:53.5pt;mso-pagination:widow-orphan'>Съдът, след анализ събраните доказателства поотделно и в съвкупност, прие следното:<o:p></o:p></p> <p class=3DStyle9 style=3D'text-indent:52.3pt;mso-pagination:widow-orphan'>Не е налице спор, установява се и от представените и неоспорени от страните писмени доказателства в тази насока, че ищцата е придобила право на строеж върху процесния имот, по силата на възмездна сделка покупко -продажба, за която е съставен нот.акт № 156, т. 33. н.д. № 10695/96г. на нотариус М.  Ц.  С нот. акт № 100, т. 4, per. № 4344, дело № 787 от 2000 г. на нотариус  Н.  Д. с район на действие РС-Пловдив, ищцата, действаща чрез пълномощника си Г. И. П. , на 29.11.2000г. е отчуждила възмездно в полза на ответника Б. П. Б. трансформиралото се вече право на строеж в право на собственост върху процесния имот.<o:p></o:p></p> <p class=3DStyle8 style=3D'margin-top:.25pt;text-indent:42.0pt;mso-pagination:widow-orphan'>Като доказателство по делото е прието,неоспорено от страните, пълномощно per. № 3784 от 09.08.2000г. на нотариус  Т.  К. с per. № 227, от 09.08.2000г., с което ищцата е упълномощила  Г.  И. П. да я представлява пред нотариус, съд, прокуратура и пр.... при сключване на сделки от нейно име и за нейна сметка..." и „ да сключва договори за покупко-продажба от нейно име по гражданско правни сделки за движими вещи и недвижими имоти по усмотрение на упълномощената относно цената и клаузите на договорите...".<o:p></o:p></p> <p class=3DStyle9 style=3D'margin-top:3.1pt;text-indent:52.55pt;line-height:15.85pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>При така установеното от фактическа страна решаващият първоинстанционен съд е приел,че предявеният иск е изцяло неоснователен, поради което го е отхвърлил изцяло. За да достигне до този извод,решаващият съд е приел,че е налице валидно, надлежно упълномощаване от страна на ищцата в полза на лицето Г.П. с генерално пълномощно,с която едностранна сделка последната е получила надлежно мандат включително да се разпорежда в недвижимия имот,собственост на ищцатащредмет на настоящия спор,по своя преценка досежно купувача,цената и пр.клаузи на договора,което упълномощената е сторила.<o:p></o:p></p> <p class=3DStyle9 style=3D'margin-top:.25pt;text-indent:52.8pt;line-height:15.85pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>При служебната проверка по чл.269 ГПК за валидност и допустимост на обжалваното решение Апелативният съд не констатира пороци на същото.<o:p></o:p></p> <p class=3DStyle9 style=3D'text-indent:52.8pt;line-height:15.85pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Настоящият състав на въззивния съд намира,че обжалваното решение е правилно и законосъобразно. Изводите на първоинстанционния съд кореспондират на събраните доказателстващоради което решението изцяло следва да бъде потвърдено,като на осн.чл.272 ГПК въззивният съд препраща към мотивите на първоинстанционния съд. Правилно и обосновано ОС е приел,че при сключване на атакуваната сделка упълномощената Г.  П. е действала надлежно,в рамките на предоставената й с пълномощното властщоради което валидно е изразила именно в тези рамки съгласие от името на ищцата- упънмощител,поради което сделката с ответника относно собствеността на процесния имот не страда от твърдения порок - липса на съгласие от страна на продавача.<o:p></o:p></p> <p class=3DStyle9 style=3D'margin-top:.5pt;text-indent:56.65pt;line-height:15.85pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>Поради изложеното Апелативният съд намира,че обжалваното решение следва на осн. чл.272 ГПК следва да бъде потвърдено,а въззивната жалба против него - като неоснователна следва да бъде оставена без уважение.
