Б.  У. в качеството му на управител и едноличен собственик на капитала в „М." ЕООД-Стара Загора против определение № 145 от 24.02.2010 год., постановено по т.д. № 96/2010 год. по описа на Окръжен съд-Стара Загора.<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:35.5pt;line-height:16.1pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>С обжалвания съдебен акт е допуснато обезпечение на предявения от Д. К. В. от гр. С. иск срещу „М." ЕООД-Стара Загора с цена 45 000 евро и левова равностойност 88 012.45 лева чрез обезпечителна мярка „възбрана" върху недвижим имот - два броя апартаменти подробно описани в диспозитива на определението. Обезпечението е допуснато под условие - внасяне на парична гаранция в размер на 1 000 лева. Със същия съдебен акт е оставено без уважение искането за допускане на обезпечение -чрез налагане на възбрана и върху трети недвижим имот.<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:35.5pt;line-height:16.1pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>За да допусне обезпечението решаващият съдия е приел, че исковата претенция е вероятно основателна от една страна и от друга - че в полза на молителя съществува обезпечителна нужда /правен интерес от исканото обезпечение/. Мотивирал е защо обезпечението следва да се допусне под условие и е определил размера на гаранцията, която ищецът следва да внесе, за да получи обезпечителна заповед - чл. 391, ал. 3 от ГПК.<o:p></o:p></p> <p class=3DStyle6 style=3D'margin-top:3.35pt;text-indent:34.8pt;line-height:16.1pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>Жалбоподателят претендира отмяна на обжалвания съдебен акт поради противоречието му със съдопроизводствените правила и материалния закон. Твърди, че представените писмени доказателства не налагат извод за вероятната основателност на предявения иск ; че разполага с достатъчно активи като търговец, които сами по себе си обезпечават бъдещо вземане на ищцата, т.е. не е налице необходимост от обезпечаване на правата й по евентуално осъдително решение в нейна полза ; че данъчната оценка на един от апартаментите е в размер на 80 472.20 лева и това е достатъчна гаранция за ищцата, поради което алтернативно развива тезата - при основателност на искането за допускане на обезпечение, „същото да се остави в сила само по отношение на апартамент № 6, със застроена площ от 129.48 кв.м., находящ се на втори жилищен етаж от жилищна сграда в гр. С., ул. „С." № 216, заедно с прилежащите му ид.ч. от общите, тъй като стойността на веща е напълно достатъчна да покрие евентуалните вземания на ищцата, като увеличите размера на дължимата гаранция и отмените допуснатото обезпечение в частта на апартамент № 14, със застроена площ от 101.20 кв.м.".<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:35.5pt;line-height:16.1pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Ответницата по частната жалба е взела становище, в което твърди, че обжалваното определение е правилно, законосъобразно и моли същото да се остави в сила. Развива теза за недопустимост - поради просрочие на частната жалба и алтернативно - за нейната неоснователност.<o:p></o:p></p> <p class=3DStyle6 style=3D'margin-top:.25pt;line-height:16.1pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Настоящият състав на Апелативен съд-Пловдив намира, че частната въззивна жалба е подадена в срок и от страна в производството, която има правен интерес от обжалване.<o:p></o:p></p> <p class=3DStyle6 style=3D'margin-top:.25pt;text-indent:35.05pt;line-height:16.1pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>Неоснователно е възражението на ответницата Д.В,. че жалбата е недопустима поради просрочването й.<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:35.05pt;line-height:16.1pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Видно от представеното фотокопие от съобщително писмо на  С. по вписванията-гр. Стара Загора до жалбоподателя „М." ЕООД-Стара Загора, същото е връчено на 11.03.2010 год., а частната въззивна жалба е входирана в деловодството на Окръжен съд-Стара Загора на 18.03.2010 год.<o:p></o:p></p> <p class=3DStyle6 style=3D'line-height:16.1pt;mso-line-height-rule:exactly; mso-pagination:widow-orphan'>Съгласно чл. 396 от ГПК определението на съда по обезпечение на иска може да се обжалва с частна жалба в едноседмичен срок, който за ответника тече от деня, в който му е връчено съобщение за наложената обезпечителна мярка от съдебния изпълнител или от службата по вписванията или изводът, който следва е за спазен срок при депозиране на частната жалба срещу определението, с което е допуснато обезпечение.<o:p></o:p></p> <p class=3DStyle6 style=3D'margin-top:.5pt;text-indent:35.05pt;line-height:16.1pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>Разгледана по същество частната въззивна жалба се явява неоснователна, като съображенията за това са следните :<o:p></o:p></p> <p class=3DStyle6 style=3D'margin-top:.95pt;line-height:15.85pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Първоинстанционният съд правилно е преценил обусловената от исковата молба и доказателствата към нея фактическа обстановка и е направил законосъобразни изводи за нуждата от допускане на претендираната обезпечителна мярка - възбрана върху недвижим имот. Правилни са съжденията му за вероятната основателност на предявения осъдителен иск, както и тези свързани с наличие на втората предпоставка за допускане на обезпечението - когато без него за ищеца ще бъде невъзможно или ще се затрудни осъществяването на правата по решението.<o:p></o:p></p> </div> <br clear=3Dall style=3D'page-break-before:auto;mso-break-type:section-break'>  <div class=3DSection2> <p class=3DMsoNormal style=3D'margin-top:6.6pt;line-height:12.0pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'><o:p>&nbsp;</o:p></p> <p class=3DStyle6 style=3D'margin-top:3.35pt;text-indent:35.05pt;line-height:16.1pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>Не могат да бъдат споделени от въззивния състав изложените в частната жалба оплаквания за неправилна преценка на доказателствата от първоинстанционния съд и направеният извод за вероятна основателност на иска. Развитите в тази насока мотиви от жалбоподателя са свързани с разглеждане на спора по същество и не могат да бъдат предмет на обсъждане и съдебен контрол от въззивната инстанция в едно предварително производство, каквото е обезпечителното. Наличието, респ. липсата на основания за разваляне на сключените между страните договори за строителство подлежат на доказване в бъдещото съдебно производство и след обсъждането им в съвкупност, ще определят диспозитива на решението.<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:35.5pt;line-height:16.1pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Твърдението на жалбоподателя, че притежава достатъчно имущество, за да удовлетвори правата на ищеца при евентуално осъдително решение от една страна не е подкрепено с доказателства, а от друга е в противоречие с твърдяното от него тежко икономическо положение в страната, което се отразява и върху неговата стопанска дейност. Тезата, че разполага с недвижими имоти, които са в имота, където са и възбранените апартаменти и от тях Д. В.  може да се удовлетвори е неоснователна, защото от една страна е недоказана и от друга - тези недвижими имоти могат да са били предмет на сделка /покупко-продажба/, т.е. „М." Е.  да не е техен собственик.<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:35.75pt;line-height:16.1pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Настоящият състав на Апелативен съд-Пловдив не може да приеме тезата за асиметричност между цена на иск и допуснато обезпечение чрез възбрана върху два недвижими имота, чиято цена надхвърляла значително исковата претенция. Приложените в тази насока доказателства към частната жалба -оценка на жилищата от ТД „С." ООД-Стара Загора са от една страна в сериозно ценово противоречие с представената експертна оценка от  С.  К. пред първоинстанционния съд, а от друга са частни документи, изходящи от заинтересована страна, поради което въззивният състав не може да ги приеме и съобрази с останалите доказателства.<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:35.5pt;line-height:16.1pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Представеното удостоверение за данъчна оценка по чл. 264, ал. 1 от ДОПК за апартамент № 6, която е в размер на 80 472.20 лева, също не може да бъде основание за направеното алтернативно искане - при основателност на молбата за допускане на обезпечение „същото да се остави в сила само по отношение на апартамент № 6, със застроена площ от 129.48 кв.м., находящ се на втори жилищен етаж от жилищна сграда в гр. С., ул. „С." № 216, заедно с прилежащите му ид.ч. от общите, тъй като стойността на веща е напълно достатъчна да покрие евентуалните вземания на ищцата", тъй като цената на предявения иск е в размер, надвишаващ този на данъчната оценка.<o:p></o:p></p> <p class=3DStyle6 style=3D'margin-top:.95pt;line-height:15.85pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Не може да се приеме и направеното искане за увеличаване размера на определената от съда парична гаранция по чл. 391, ал. 2 от ГПК.<o:p></o:p></p> <p class=3DStyle6 style=3D'margin-top:.5pt;text-indent:35.5pt;line-height:15.85pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>От една страна законодателят е предоставил права на съда -- при наличие на определена хипотеза /чл. 391, ал. 2 от ГПК/, да задължи ищеца да представи парична или имотна гаранция, чийто размер се определя от размера на преките и непосредствени вреди, които ответникът ще претърпи, ако обезпечението е неоснователно и съдът се е възползвал от това си правомощие.<o:p></o:p></p> </div> <br clear=3Dall style=3D'page-break-before:always;mso-break-type:section-break'>  <div class=3DSection3> <p class=3DStyle6 style=3D'margin-top:3.35pt;text-indent:35.5pt;line-height:16.1pt;
