В. А., роден в Република  А. , гражданин на Р.  Ф. , представляван от пълномощника си по делото адвокат Б.В.П,. от  А. колегия- гр. С. против определение № 852 от 11.12.2009 г, постановено по търг. дело № 375/2009 г по описа на Окръжен съд - град К..<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:24.0pt;mso-pagination:widow-orphan'>По силата на обжалваното определение първоинстанционният съд е оставил без уважение молбата на ищеца А.  А. , гражданин на Р. федерация за допускане на обезпечение на предявените искове против ответното търговско дружество „Б.„ООД- град К. чрез налагане на възбрана по отношение на конкретни недвижими имоти.<o:p></o:p></p> <p class=3DStyle6 style=3D'text-indent:24.0pt;mso-pagination:widow-orphan'>В частната жалба се излагат съображения за постановяване на обжалваното определение в нарушение на закона - чл.391 от ГПК, както и се прави довода, че към настоящия момент са отстранени визираните недостатъци на исковата молба, която вече е редовна.<o:p></o:p></p> <p class=3DStyle5 style=3D'mso-pagination:widow-orphan'>Пловдивският Апелативен съд след преценка на събраните по делото доказателства, приема за установено следното:<o:p></o:p></p> <p class=3DStyle6 style=3D'margin-top:3.1pt;text-indent:20.9pt;mso-pagination:widow-orphan'>Първоинстанционният съд е бил сезиран е иск по чл.55,ал. 1 предл. 2-ро or ЗЗД при хипотезата на получено при неосъществено правно основание.<o:p></o:p></p> <p class=3DStyle5 style=3D'text-indent:13.7pt;mso-pagination:widow-orphan'>По делото като доказателства по исковата молба са представени предварителен договор от 01.09.2007 г за покупко-продажба на недвижим имот - апартамент № 160 на четвъртия етаж, със застроена площ от 41.70 кв.м. Към този основен договор е представен и анекс от 02.09.2007 г, както и втори анекс към договора от 21.11.2008 г.<o:p></o:p></p> <p class=3DStyle5 style=3D'text-indent:16.8pt;mso-pagination:widow-orphan'>Съгласно чл.б.и чл.7 от този последен анекс страните са предоговорили крайния срок за прехвърляне на правото на собственост , като продавачът е дал съгласието си и е декларирал, че апартамента ,предмет на предварителния договор ще бъде напълно завършен и обзаведен, съгласно спесификация га -Приложение № 1 -не по-късно от 10.06.2009 г. В чл.8 от същия анекс страните поемат задължението да сключат окончателния договор за продажба във формата на нот.акт не по-късно от 10.06.2009 г.<o:p></o:p></p> <p class=3DStyle5 style=3D'text-indent:17.05pt;mso-pagination:widow-orphan'>Съобразно чл.10 от същия анекс страните изрично са уговорили ,че при неизпълнение на задължението от страна на продавача, купувачът има правото да развали предварителния договор , без да се определя нов допълнителен срок за изпълнение.<o:p></o:p></p> <p class=3DStyle5 style=3D'text-indent:17.05pt;mso-pagination:widow-orphan'>Такава възможност има изправната страна и по силата на закона -чл.87 ,ал.2 от ЗЗД. Купувачът е отправил писмено уведомление до продавача , с което последния е известен за развалянето на предварителния договор. К. „Пълдин  В. „ООД- град П..<o:p></o:p></p> <p class=3DStyle5 style=3D'margin-top:.25pt;text-indent:20.4pt;line-height:15.85pt; mso-line-height-rule:exactly;mso-pagination:widow-orphan'>Въпросът за нищожността на суперфициарната сделка поради липса на предмет, с оглед на твърдението, изложено в частната жалба в смисъл ,че сградата е построена на степен „ груб строеж " още към 08.08.2007 г- не може да бъде разгледан в настоящото производство.<o:p></o:p></p> <p class=3DStyle5 style=3D'text-indent:17.05pt;line-height:15.85pt;mso-line-height-rule: exactly;mso-pagination:widow-orphan'>Тази нищожност не може да бъде релевирана по предявения иск, чието обезпечение се иска.
